There is a vast array of studies and guidelines available regarding the management of protected areas (PAs). However, little has been done so far to correlate best practice in PA management with the laws and regulations that govern PAs and establish the legal framework within which they are managed. But it is increasingly recognized that national legislation plays a critical role in underpinning the infrastructure and management necessary for successful PAs and PA systems, as well as in implementing relevant international conventions.
These considerations led the IUCN Environmental Law Centre (ELC) to embark on a three year project to prepare Guidelines for Protected Areas Legislation. The aim of the Guidelines is to illustrate the key elements of a modern and effective legal framework, attuned to the present roles and corresponding diversification of protected areas, as well as to the emergence of new scientific understanding about protected areas management and new governance approaches. The Guidelines update and vastly expand on the original 1980 IUCN ELP version to reflect new protected areas principles and directions. The methodology is to anchor this work in practice, making the Guidelines the result of cooperation between PA legal and management experts. Various case studies will support the elements presented in the Guidelines, which will cover marine, as well as terrestrial PAs, government-managed, as well as community-conserved and privately-managed areas, and also consider transboundary situations.
The ELC is supported in this project by the Joint Task Force of the IUCN Commission on Environmental Law (CEL) and the World Commission on Protected Areas (WCPA), and other partners, including the University of Ottawa and IUCN Academy of Environmental Law project on Comparative Law and Policy on PAs.
Over the past few months, two successive drafts of the Guidelines have been prepared, and reviewed by the project Steering Group and the Task Force. The positive comments received on Working Draft 2 lead us to initiate a second round of comments, and open its review to a wider circle of experts.
We are now seeking comments on this draft through an Online Review, and your comments would be greatly appreciated.
